Terms & Conditions

Agreement to Rules: By entering into the Smarties® U Giveaway (the “Contest”), you agree to abide by these rules (the “Official Rules”) and the decisions of Smarties, which are final and binding. Winning a prize is contingent upon fulfilling all the requirements set forth herein. This Contest is sponsored by Smarties Candy Company, owner of the trademark Smarties® (referred to in these rules as “Smarties”).

Promotion Period: The Smarties® Sweet Switch Giveaway will run from Tuesday, October 1, 2024, through Saturday, November 30, 2024.

Eligibility: Participants must:

1. Have a valid U.S. mailing address to be eligible to receive any prizes.

2. Be either:

  • Parents or legal guardians, aged 18 or older, applying on behalf of a child who has received candy they can not eat due to dietary restrictions; or
  • Adult students aged 18 or older who are applying on their own behalf.

A “picture of Halloween candy” refers to a digital copy or photo of the Halloween candy received and taken during the promotion period (October 1, 2024, through November 30, 2024).

Employees of Smarties and their immediate family members (spouses, parents, children, siblings, and their respective spouses) are not eligible for the Contest. Those living in the same household as an employee of Smarties or any of the participating brands are not eligible for the Contest. The Contest is void where prohibited or restricted by law.

For participants submitting on behalf of children under the age of 13: If the child is under the age of 13, the entry must be anonymized by removing any personally identifiable information (e.g., student’s name, address). If personal information is included, the parent or legal guardian must provide verifiable parental consent in accordance with COPPA regulations before the entry can be accepted. As a matter of prudence, Smarties encourages anonymizing the child’s information to limit data collection.

How to Enter: To enter, submit a photo of the Halloween candy during the promotion period via the Smarties® Sweet Switch Submission Form by clicking the “ENTER HERE” button. NO PURCHASE NECESSARY. PURCHASING PRODUCT FROM SMARTIES OR A PAYMENT OF ANY KIND WILL NOT INCREASE THE CHANCES OF WINNING. Only one entry per student and/or family is allowed. Entries must be submitted by a parent or legal guardian on behalf of the student, or by an adult student on their own behalf, and must comply with the eligibility requirements stated above.

Prizes:

  • Up to one hundred (100) winners will receive a Sweet Switch box featuring one (1) 5oz Smarties® Peg Bag, two (2) Smarties® Lollies, two (2) Giant Smarties® Rolls, two (2) Mega Smarties® Rolls, two (2) Smarties® Candy Necklaces.
  • All applicants will receive a $5 discount on a $25 purchase from Tuesday, October 1, 2024, through Saturday, November 30, 2024. Cannot be used in combination with any other discounts. Limit one use per customer. 

Smarties reserves the right to modify these prizes by substituting alternative awards of equal or greater value at its sole discretion and may do so at any time without notice. All prize winners are responsible for all federal, state, and local taxes related to the prize. Prizes are non-transferable and non-assignable, with no cash redemptions or substitutions, except at Smarties’ sole discretion.

Winner Selection: Winners will be selected through a random drawing conducted on December 2, 2024. Each winner will be contacted by a Smarties team member via email from an official @smarties.com address (e.g., sweetswitch@smarties.com) and will have 5 business days to respond and provide any requested information or documentation, such as proof of eligibility if applicable. Failure to respond will result in forfeiture of the prize, and an alternate winner may be selected at random. This process will continue until a winner is confirmed. Prizes will be delivered within 4-6 weeks following confirmation of the winner.

General Conditions: Smarties reserves the right to modify, suspend, or terminate the promotion at any time without notice. All decisions made by Smarties regarding the promotion are final and binding. Smarties reserves the right to disqualify any individual found to be tampering with the entry process or the operation of the Contest or acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner.

Privacy: By participating in the Contest, each Contestant authorizes Smarties to collect, use, process, transfer, and store all data provided by such Contestant, including without limitation personal data, in and to the United States or any location(s) throughout the world that Smarties deems necessary for the purposes of administering the Contest. Any data related to children under the age of 13 must be anonymized unless verifiable parental consent is provided in compliance with COPPA. All information submitted will be treated in accordance with Smarties’ privacy statement, available at https://www.smarties.com/privacy-policy/.

Release and Limitations on Liability: By participating in the Contest, Contestants agree to release and hold harmless Smarties, and each of its respective affiliates, sales representatives, distributors, licensees, agents, advertising and Contest agencies, and all directors, trustees, officers, and employees of any of the foregoing entities (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Contest, or receipt or use of any prize.

Miscellaneous: The decisions of Smarties are final with respect to all aspects of this Contest. The Contest and these Official Rules will be governed, construed, and interpreted under the laws of the State of New Jersey, without regard to choice of law principles. Except where prohibited, each Contestant agrees that all disputes shall be resolved individually in state or federal courts situated in Union Township, New Jersey.
